Standard Terms and Conditions of Sale
- The customer expressly waives its own general terms and conditions, even if they are drawn up after these General Terms and Conditions of Sale. Any deviation from these terms shall be valid only if it has been expressly agreed upon in advance and in writing.
- Our invoices are payable within three (3) business days, unless another payment period is specified on the invoice or in the order. In the event of non-payment by the due date, Pyratec reserves the right to claim a fixed interest charge of ten percent (10%) of the outstanding unpaid amount. Pyratec also reserves the right to suspend the provision of any services without prior notice in the event of late payment. If any amount remains unpaid for more than sixty (60) days after the due date, Pyratec reserves the right to engage the services of a debt-collection company. All legal and collection costs shall be borne by the customer.
- Certain countries apply withholding tax to invoice amounts in accordance with their domestic legislation. The customer is responsible for paying any such withholding tax to the tax authorities. Under no circumstances shall Pyratec bear any costs related to the legislation of any country. Accordingly, the invoice amount is due in full to Pyratec and shall not include or be reduced by any costs arising from the legislation of the country in which the customer is located.
- Pyratec undertakes to use its best efforts to provide high-performance services in a timely manner and in accordance with the agreed schedules. However, none of its obligations shall be deemed an obligation to achieve a specific result. Under no circumstances may the customer require Pyratec to appear as a third party in connection with any claim for damages brought by an end consumer against the customer.
- For any claim to be admissible, Pyratec must be notified thereof by a letter sent by registered mail to its registered office within no more than eight (8) days from the date of delivery of the goods or the provision of the services. All our contractual relationships are governed exclusively by applicable law.
